General (Ticket) Terms and Conditions of STRAAL B.V.

These general (ticket) terms and conditions of STRAAL B.V., registered at Beekstraat 22a, 6017 AB, Thorn, the Netherlands (Chamber of Commerce no. 98102036) — hereinafter referred to as “the Organizer” — apply to all agreements between the Organizer and visitors of its events, including but not limited to “STRAAL Events”.


Article 1 – Applicability

1.1 These terms and conditions apply to every agreement between the visitor and the Organizer relating to the purchase of tickets and attendance of any event, regardless of how the agreement was formed.
By purchasing a ticket and/or entering the event site, the visitor agrees to these terms and conditions.

1.2 The Organizer and/or venue operators may apply additional house rules, which are valid alongside these terms and can be found on the Organizer’s website(s) and/or at the event location.
By purchasing a ticket, the visitor also agrees to comply with those house rules.

1.3 The Organizer may amend these terms and conditions at any time, in whole or in part. Visitors will be informed in due time through a notice on the Organizer’s website(s).
If the visitor does not object in writing within ten (10) working days, they are deemed to have accepted the amended terms.

1.4 If any provision of these terms is found to be invalid, the remaining provisions shall remain in full force and effect.

1.5 The visitor’s own general terms and conditions do not apply.


Article 2 – Ticket Purchase

2.1 An agreement between the Organizer and the visitor is concluded once a ticket order has been placed through an authorized sales channel of the Organizer.

2.2 Once an order is placed, it is final and cannot be changed by the visitor.
The Organizer reserves the right to refuse orders or impose additional conditions.

2.3 Information about the event and tickets is provided as accurately as possible.
Additional costs (for reservation, payment, or delivery) may cause the total ticket price to differ from the printed price.
The Organizer is not liable for any inaccuracies in the provided information.

2.4 The Organizer may set a maximum number of tickets per order. The visitor must comply with these limits.

2.5 Tickets cannot be returned. Article 6:230p sub e of the Dutch Civil Code applies.

Article 3 – Tickets and Admission

3.1 Visitors must present a valid ticket and valid ID upon entry to the event site.

3.2 Tickets are issued once and grant access only to the ticket holder. Parking areas are only accessible with a valid parking ticket.

3.3 Eventix (eventix.io) is the exclusive ticket provider of the Organizer. Tickets are only available via the Organizer’s website and Eventix.

3.4 Tickets are sent after payment. The visitor must check that the tickets have been received and are correct. Any issues must be reported in writing.

3.5 Tickets remain the property of the Organizer. The visitor bears the risk of loss, theft, damage, or misuse. Replacement tickets may be refused or issued at the visitor’s expense.

3.6 It is prohibited to sell or transfer tickets to third parties for commercial purposes.

3.7 Tickets may only be transferred to third parties through TicketSwap, provided that this is done free of charge or non-commercially and under TicketSwap’s conditions.

3.8 The visitor remains responsible for compliance with these terms by any third party to whom the ticket is transferred.

3.9 The Organizer may sell tickets on a personalized basis and has the right to verify the ticket holder’s identity.
If the ticket holder’s identity does not match the registered name, entry may be refused.

Article 4 – Liability

4.1 Visitors enter the event site and attend the event at their own risk.
The Organizer is not liable for any loss of or damage to personal belongings.

4.2 The Organizer is not liable for the cancellation of the event, program changes, or any other damage, unless caused by intent or gross negligence on the part of the Organizer.

4.3 Any liability of the Organizer is limited to direct damages only, up to the amount paid out under the Organizer’s statutory liability insurance.

4.4 Loud music will be played during the event; hearing protection is strongly recommended.

4.5 The Organizer is not liable for any infection or transmission of diseases, including but not limited to COVID-19, SARS, or MERS.


Article 5 – Event Cancellation or Rescheduling

5.1 The Organizer may cancel or reschedule the event in cases of force majeure, including illness of performing artists, strikes, government measures, adverse weather conditions, epidemics, or pandemics.

5.2 If the event is cancelled before it starts, without force majeure, the ticket price and service fees will be refunded.
If the event is cancelled during the event, only a partial refund will be provided.
Visitors are not entitled to an alternative event or voucher.

5.3 If the event is rescheduled due to force majeure (other than government measures or epidemics), the ticket remains valid for the new date.
If the visitor cannot attend the new date, they may request a refund minus service fees.

5.4 If the event is rescheduled due to government measures or epidemics, the ticket remains valid.
If the visitor cannot attend, they may request a refund minus service fees within the specified period.

5.5 If the event is cancelled due to government measures or epidemics, the visitor is entitled to a refund of the ticket price and service fees within three months of the cancellation date.

5.6 Visitors who resell tickets in violation of Article 3.6 are not entitled to a refund.


Article 6 – House Rules

6.1 Visitors must follow all house rules and instructions from the Organizer and authorized personnel.
The Organizer may deny access in cases of non-compliance or if order and safety are at risk.

6.2 Persons under the age of 18 will not be admitted.

6.3 Identification may be required, particularly for the sale of alcoholic beverages.

6.4 Security searches may take place. Refusal to comply may result in denied entry.

6.5 Health checks may be carried out if deemed necessary.

6.6 Digital cameras and mobile phones are permitted, but professional recording equipment is strictly prohibited.

6.7 Professional recording, photography, or broadcasting without prior consent from the Organizer is not allowed.

6.8 The following are strictly prohibited: bringing your own food or drinks (except sealed bottles of up to 0.5 L without caps), glass, cans, chairs, inflatable objects, pets, drugs, weapons, fireworks, or professional recording equipment.
Illegal items will be handed over to the police.

6.9 Smoking is only allowed in designated areas. Any fines imposed may be charged to the visitor.

6.10 Crowdsurfing, lighting fires, conducting commercial activities, discriminatory behavior, and bringing pets are all strictly prohibited.


Article 7 – Payment Methods

7.1 Payment instruments (such as chips, cards, or tokens) are used for purchasing food and drinks at the event site.
Exceptions include cigarettes, merchandise, and locker rentals.

7.2 Payment instruments can be obtained at designated cash desks.
Credit cards and €200/€500 banknotes are not accepted.

7.3 Any unused credit can be refunded in cash during the event.

7.4 Remaining balances expire after the event.

7.5 The Organizer is not liable for the loss or theft of payment instruments.

7.6 In case of technical issues or maintenance, the use of payment instruments may be temporarily restricted.


Article 8 – Privacy and Personal Data

8.1 When entering into an agreement, personal data may be collected and processed by the Organizer.

8.2 The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR).

8.3 By purchasing a ticket, visitors consent to the processing of their data in line with the Organizer’s privacy policy.

8.4 Photo and video recordings may be made and published without any form of compensation.
Media partners are also permitted to make recordings for promotional purposes.

8.5 Neighboring rights, copyright, and portrait rights related to recordings are irrevocably transferred to the Organizer.
Visitors agree to cooperate in any additional transfer that may be required.

8.6 CCTV monitoring may be in use for safety and security reasons.
Recordings may be shared with authorities in case of incidents or emergencies.


Article 9 – Final Provisions

9.1 These terms and conditions are governed exclusively by Dutch law.

9.2 Any disputes arising from these terms and conditions shall be submitted solely to the competent court in Roermond, the Netherlands.
